A new regulation has been adopted that directly affects med spas. Texas Administrative Code Title 22, Part 9, Chapter 169, Subchapter E, Rule §169.26 outlines the responsibilities of physicians when delegating medical acts to other individuals. This rule is part of the regulations established by the Texas Medical Board to ensure safe and effective delegation practices. Note that nothing in the rule addresses or changes good faith exams, and it actually expands §193.17 in that now it allows for a nurse practitioner to be available for a phone consult, not just the doctor. This infographic outlines some of the key provisions of Rule 169.26 for med spas.
