Successful Peer Review Appeal For Physician on Hospital's Decision to Terminate Residency

On July 7, 2023, Partner Mark A. Weitz won a peer review appeal for a physician client, overturning the hospital’s initial decision to terminate his residency program just two months prior to graduation.

Mark successfully undermined the hospital’s evidence that formed the basis of the dismissal, much of which comprised mere conclusions. Additionally, he was able to marshal evidence showing that the allegations had no basis in fact, demonstrated that the dismissal was based in great part on inuendo that lacked any substance evidence, and identified repeated instances where the hospital failed to follow its own peer review process.

As a result, a doctor who had spent over two years in residency will now be allowed to graduate and move on with is career.
